Section 2.05. Private school participation.

  • A corporation or public agency may apply for funds on behalf of a private school as specified under s. EEB 2.04(3m) if the corporation or public agency and the executive officer or board of the private school agree to all of the following assurances:
    (1)  Funds received under this chapter may not be used for religious activity or religious instruction.
    (2)  Any materials purchased shall be nonsectarian in nature and content and may not be used for religious activity or religious instruction.
    (3)  Title to and administrative control of any capital goods purchased shall remain with the corporation or public agency. As long as the environmental education program remains in effect and meets the requirement under sub. (2) , the capital goods may be located in the private school facility.
    (4)  With respect to instructors' salaries, grant funds may only be used to supplement a private school instructor's contractual salary.
