Chapter 662. Hazardous Waste Generator Standards |

Section 662.011. Hazardous waste determination.

- A person who generates a solid waste, as defined in s. NR 661.02 , shall determine if that waste is a hazardous waste using the following method:(2) The person shall then determine if the waste is listed as a hazardous waste in subch. D of ch. NR 661 (lists of hazardous wastes) .(3) For purposes of compliance with ch. NR 668 , or if the waste is not listed in subch. D of ch. NR 661 (lists of hazardous wastes), the generator shall then determine whether the waste is identified in subch. C of ch. NR 661 (characteristics of hazardous waste) by any of the following:(a) Testing the waste according to the methods set forth in subch. C of ch. NR 661 (characteristics of hazardous waste), or according to an equivalent method approved by the department under s. NR 660.21 .1. Chemical and physical samples shall be analyzed by a laboratory certified or registered under ch. NR 149 , except for field analyses for pH, specific conductance and temperature.(b) Applying knowledge of the hazard characteristic of the waste in light of the materials or the processes used.

Note:
Even if the waste is listed, the generator still has an opportunity under s.
NR 660.22
to demonstrate to the EPA that the waste from the generator's particular facility or operation is not a hazardous waste.
