Section 135.41. Interim reclamation waiver.

If the regulatory authority determines that areas within a mining site have been successfully reclaimed on an interim basis in accordance with the reclamation plan, the regulatory authority:

(1) Shall waive annual acreage fees for those areas, and

(2) May reduce or waive financial assurance requirements for those areas.
