Section 11.08. Emergency awards.

Latest version.
  • (1) Amount of award. The department may order the payment of an emergency award not to exceed $500, or an amount not to exceed $2,000 for funeral and burial expenses, if the department determines in a particular claim that an undue hardship will result to the applicant if immediate payment is not made and the probability exists that an award will be made. "Undue hardship" means an applicant or victim will be deprived of food, lodging, medical treatment or burial as a direct result of an injury or death.
    (2) Application to be filed. An applicant shall file an application with the department which shall be supported by a written request for an emergency award citing the undue hardship that will result to the victim if an immediate award is not made.
    (3) Repayment. The department shall deduct the amount of the emergency award from the final award. If the amount of the emergency award exceeds the final award or no final award is ordered, the applicant shall repay the department within 30 days of the demand by the department for payment.
