Business Impact Analysis (Summary)
This rule deals with the clean sweep program, which awards grants only to
local government entities
for expenses related to the collection of and disposal of unused agricultural pesticides, household waste, and unwanted prescription drugs. Accordingly, the rule does not directly impact businesses or business sectors. The funding of local governments’ waste disposal programs come from other sources besides the clean sweep program, including coverage of their own costs. The rule will continue to benefit certain small businesses such as farmers, farm supply stores, and cooperatives that generate small quantities of waste pesticides per month, since clean sweep collections provide a no- or low-cost method of disposing of agricultural pesticides and other farm chemical waste.
Comments from Legislative Committees (Summary)
On March 6, 2015, DATCP transmitted the above rule for legislative committee review. The rule was assigned to the Assembly Committee on Agriculture and the Senate Committee on Agriculture, Small Business and Tourism. Neither committee took action. Both the Senate and Assembly referred the rule to the Joint Committee for Review of Administrative Rules (JCRAR) on April 20, 2015. JCRAR took no action on the rule.
